The Gas Man Cometh....To Drill For Oil/Gas On Your Land!

There's a knock at your door and when you open it the gas man is there. But it's not the gas man from your local gas company who has come to check out your home because you smelled an odor of gas or to put in a new meter.
No, this is the gas man from a company that wants to DRILL for oil/gas on or very near to your property.
He explains to you that:

  • the project will require X number of acres and that all the homeowners involved will "throw in" a certain portion of their land (no title transfer of any kind) and they will all be required to sign a lease.
  • if the well is near your property you will be entitled to profits from the drilling. "How much?" you ask. He says, "that depends on the amount we are able to extract."( Some people I know personally were told that it could be $500 or $1000 per month, but admittedly that was when oil was selling for $90.00 or more a barrel)
  • if the well is on your property you may be entitled to free gas heat for your home.

Sounds good right? So you might say, "This is a big deal and an important decision for our family.  We'll gas welldiscuss it and get back to you."

Many questions can be answered by reading about  the passage of bill 278, in 2004, which gives control over these matters largely to the State of Ohio, not the homeowner:

"The Cuyahoga Court of Common Pleas recently upheld 125th General Assembly HB 278, enacted in 2004.  This law abolished municipal home rule power to regulate gas wells and declared that the Division of Mineral Resources Management in the Department of Natural Resources has exclusive authority to regulate the permitting, location, and spacing of oil and gas wells in the state."
